Terms of service

Last updated: 14 September 2026

These Terms govern the provision of electronic services through HomeNest, including accounts, business subscriptions and directory access.

1. General provisions

  1. 1.1.

The service provider is Anna Bradshaw, trading as Anna Bradshaw Consulting Services, Kiepury 8A, 96-313 Budy-Grzybek, Poland, VAT/NIP PL5291813181 (the “Provider”). Contact: support@gethomenest.com.

  2. 1.2.

“HomeNest” means the Provider’s website and applications. “User” means a person using HomeNest. “Business Customer” means a business entering into an agreement for its workspace. A person acting for a Business Customer must be duly authorised.

  3. 1.3.

The account agreement is concluded upon registration. Paid services are provided under the offer accepted at purchase and these Terms. The User must be at least 16 years of age and have the legal capacity or consent required to enter into the agreement.

  4. 1.4.

These Terms do not exclude mandatory consumer rights or the statutory protection of sole traders entering into a business-related contract which is not of a professional nature for them, where applicable.

2. Scope and conditions of service

  1. 2.1.

HomeNest provides project-management, collaboration, financial-record, document, directory and community services. The applicable offer and access permissions determine the scope available to a User. Project payment records do not constitute a payment-transfer service.

  2. 2.2.

Access requires an internet connection, a compatible web browser or mobile application, and an email address for account registration. The User is responsible for providing accurate information and safeguarding account credentials.

3. Business Pro subscriptions

  1. 3.1.

Business Pro is supplied per business workspace. Monthly and annual subscriptions are payable in advance and renew automatically for successive periods of the selected duration unless renewal is cancelled. The annual subscription fee is charged in full for the year.

  2. 3.2.

The offer accepted at purchase specifies the included features. Business Pro includes permanent access to a directory listing on the terms set out in Section 6.

4. Fees and payment

  1. 4.1.

Business prices are stated exclusive of tax unless expressly indicated otherwise. The total amount payable, currency, applicable taxes and billing period are disclosed before the order is confirmed. The Business Customer is responsible for the accuracy of its billing information.

5. Renewal and termination of a subscription

  1. 5.1.

The Business Customer may cancel renewal through the Billing section of the web application or by contacting the Provider. Cancellation takes effect at the end of the current paid period unless another effective date is expressly agreed or required by law.

  2. 5.2.

Non-payment may result in suspension of paid features. Charges for a change of plan require prior disclosure and confirmation. A subscription price change applies only to a future billing period following advance notice and an opportunity to cancel renewal.

  3. 5.3.

Cancellation of renewal does not entitle the Business Customer to a refund for the unused part of a paid period unless the accepted offer or applicable law provides otherwise. A full refund or a payment dispute may result in withdrawal or suspension of the access arising from the disputed purchase; unrelated entitlements remain unaffected.

6. Permanent directory access

  1. 6.1.

Directory-listing access may be purchased for a one-time fee or obtained with Business Pro. It is granted without a fixed expiry date for the duration of operation of the directory, subject to these Terms. Expiry or cancellation of Business Pro does not terminate that access.

  2. 6.2.

Publication is subject to the content requirements in Section 8. The purchase does not guarantee a particular search ranking or the receipt of customer enquiries.

7. Individually commissioned services

  1. 7.1.

Branding, social-media services, websites and internal tools are commissioned under a separate accepted proposal specifying the scope, fees, schedule and applicable delivery, intellectual-property and maintenance terms.

  2. 7.2.

Submission of a consultation enquiry does not constitute an order or authorisation to charge a fee. Such services are not included in Business Pro unless expressly agreed.

8. User content and prohibited conduct

  1. 8.1.

The User retains rights in submitted content and grants the Provider permission to store, reproduce and make that content available only as necessary to provide the agreed service. The User must hold the rights and authorisations necessary for its submission and disclosure. Access is governed by workspace permissions and publication settings.

  2. 8.2.

The submission of unlawful content, infringement of third-party rights, harassment, fraud, malicious software and unauthorised access are prohibited. The Provider may restrict content or accounts where necessary to address such violations, a security threat or a legal obligation, subject to applicable notice, reasoning and appeal requirements.

  3. 8.3.

Notices of unlawful content and appeals may be submitted to support@gethomenest.com, identifying the relevant content or decision and the grounds for the notice or appeal. The Provider is not a party to agreements concluded between businesses and other directory users.

9. AI-assisted functions

  1. 9.1.

AI-assisted receipt extraction and translation may produce inaccurate results. The User is responsible for verifying outputs before relying on them. These functions do not constitute professional advice. Personal-data processing is governed by the Privacy Policy.

10. Complaints and statutory withdrawal

  1. 10.1.

Complaints may be submitted to the Provider’s email or postal address, specifying the service concerned and the grounds for the complaint. The Provider responds within the statutory period, including 14 days for consumer complaints where applicable.

  2. 10.2.

A person entitled to statutory withdrawal may withdraw from a distance contract within 14 days of its conclusion without giving a reason, by an unequivocal statement sent to the Provider’s email or postal address. Dispatch before expiry of that period is sufficient.

  3. 10.3.

The following optional form may be used: “I hereby withdraw from the agreement for [service], concluded on [date]. Name: […]. Address: […]. Date: […].” The statement should be addressed to the Provider identified in Section 1 and signed if submitted on paper.

  4. 10.4.

Payments subject to statutory reimbursement are refunded within 14 days of receipt of the withdrawal statement, using the original payment method unless a different method involving no additional cost is expressly agreed. Any statutory exception or proportionate charge for service supplied during the withdrawal period applies only where the required information and express request or consent have been obtained.

  5. 10.5.

Statutory remedies for failure to supply or lack of conformity of a digital service remain available, including bringing the service into conformity and, where the legal conditions are met, a price reduction or termination. Information on consumer assistance and out-of-court dispute resolution is available from the bodies linked below.

11. Account termination and amendments

  1. 11.1.

The User may request account deletion through account settings or by contacting the Provider. Active subscriptions and any request for data export should be identified when requesting closure. Retention obligations are set out in the Privacy Policy.

  2. 11.2.

Changes to the service or these Terms may be introduced to comply with law, address security requirements or reflect changes to the service. Material changes require appropriate advance notice and preservation of applicable termination and reimbursement rights. Amendments do not retrospectively alter acquired rights for a paid period.

12. Liability and governing law

  1. 12.1.

The Provider is responsible for performance in accordance with the agreement and applicable law. These Terms are governed by Polish law, without prejudice to mandatory consumer protections under the law that would otherwise apply. Disputes are subject to the jurisdiction determined by applicable law.

  2. 12.2.

These Terms are available in Polish and English and may be saved or printed by the User.

13. Processing on behalf of Business Customers

  1. 13.1.

Where a Business Customer acts as controller of personal data submitted to its workspace, it appoints the Provider as processor for the duration of the service agreement. Processing comprises storage, organisation, retrieval, disclosure to authorised participants, backup and erasure for the provision of HomeNest. It concerns clients, staff, suppliers and project participants, and their contact, project, financial, communication and document data. The Business Customer determines the purposes, lawful basis and authorised recipients.

  2. 13.2.

The Provider processes such data only on documented instructions, including these Terms and authorised service use, unless otherwise required by law. The Provider informs the Business Customer of a legal requirement before processing where permitted, and informs it if an instruction is considered to infringe data-protection law. Persons authorised to process the data are bound by confidentiality obligations.

  3. 13.3.

The Provider implements appropriate technical and organisational measures and, taking account of the nature of processing and information available, assists the Business Customer with data-subject requests and obligations concerning security, breach response, impact assessments and prior consultation. The Provider notifies the Business Customer of a personal-data breach without undue delay after becoming aware of it.

  4. 13.4.

The Business Customer grants general authorisation to engage the providers identified in the Privacy Policy as subprocessors only insofar as they process the entrusted data. The Provider gives advance notice of additions or replacements and an opportunity to object on data-protection grounds. Equivalent data-protection obligations shall be imposed on subprocessors, for whose performance of those obligations the Provider remains responsible. International transfers require a lawful basis and applicable safeguards.

  5. 13.5.

Upon termination, entrusted personal data shall be returned or deleted at the Business Customer’s choice, unless retention is required by law. Retained backup copies remain protected pending deletion through the backup rotation. The Provider makes available the information necessary to demonstrate compliance with Article 28 GDPR and allows and contributes to audits, including inspections, subject to appropriate confidentiality and security arrangements. Processing for the Provider’s own purposes is governed separately by the Privacy Policy.
