1. Agreement to Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "you", or "your") and Anna Bradshaw Consulting Services ("Company", "we", "us", or "our") governing your access to and use of the HomeNest mobile application and website (collectively, the "Service").

By creating an account, accessing, or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not use the Service.
2. Description of Service
HomeNest is a renovation project management platform that allows users to:
- Create and manage home renovation and construction projects
- Track project stages, budgets, and expenses
- Manage tasks and to-do lists
- Store and organize project documents
- Manage supplier and contractor information
- Collaborate with team members
- Upload and store receipts, photos, and other files
3. Eligibility
To use the Service, you must:
- Be at least 16 years of age
- Have the legal capacity to enter into a binding contract
- Not be prohibited from using the Service under applicable laws
- Provide accurate and complete registration information
By using the Service, you represent and warrant that you meet all eligibility requirements.
4. Account Registration and Security
4.1 Account Creation
To access certain features of the Service, you must create an account. When creating an account, you agree to:
- Provide accurate, current, and complete information
- Maintain and update your information to keep it accurate
- Choose a strong password (minimum 8 characters with uppercase, lowercase, and numbers)
- Keep your login credentials confidential
4.2 Account Security
You are responsible for:
- All activities that occur under your account
- Maintaining the confidentiality of your password
- Notifying us immediately of any unauthorized access
We reserve the right to suspend or terminate accounts that we reasonably believe have been compromised.
4.3 Account Types and Roles
The Service supports different user roles within organizations:
- Owner: Full access including billing and organization deletion
- Admin: Can manage members, projects, and settings
- Manager: Can manage projects, stages, and tasks
- Contractor: Can view assigned stages and update progress
- Viewer: Read-only access to projects
5. User Content
5.1 Your Content
"User Content" means any data, text, files, documents, photos, images, or other materials you upload, submit, store, or transmit through the Service, including:
- Project information and descriptions
- Financial data (budgets, expenses, receipts)
- Documents (contracts, permits, invoices, warranties)
- Photos and images
- Supplier and contractor information
- Task descriptions and notes
5.2 Ownership
You retain all ownership rights to your User Content. By uploading User Content, you grant us a limited, non-exclusive, worldwide, royalty-free license to:
- Store and process your User Content to provide the Service
- Create backups for data protection purposes
- Share your User Content with team members you authorize
This license terminates when you delete your User Content or close your account, except for backup copies which are deleted according to our data retention policy.
5.3 Your Responsibilities
You are solely responsible for your User Content. You represent and warrant that:
- You own or have the necessary rights to use and share the User Content
- Your User Content does not violate any third-party rights
- Your User Content does not contain malware or malicious code
- Your User Content complies with applicable laws
5.4 Content Restrictions
You agree not to upload, post, or transmit User Content that:
- Is illegal, fraudulent, or deceptive
- Infringes on intellectual property rights
- Contains personal data of others without their consent
- Contains viruses, malware, or harmful code
- Is defamatory, harassing, or threatening
- Violates any applicable laws or regulations
6. Acceptable Use
When using the Service, you agree not to:
- Use the Service for any illegal purpose
- Attempt to gain unauthorized access to the Service or other users' accounts
- Interfere with or disrupt the Service or servers
- Reverse engineer, decompile, or disassemble any part of the Service
- Use automated systems (bots, scrapers) to access the Service
- Impersonate any person or entity
- Share your account credentials with others
- Use the Service to send spam or unsolicited messages
- Attempt to circumvent any security measures
- Use the Service in any way that could damage, disable, or impair it
7. Team Collaboration
7.1 Inviting Team Members
When you invite others to collaborate on your projects:
- You are responsible for ensuring invitees consent to receiving invitations
- You determine and manage their access levels and permissions
- You are responsible for the actions of users you invite
7.2 Accepting Invitations
When you accept an invitation to join a project:
- You agree to these Terms for your use of that project
- You acknowledge that project owners and admins can view your contributions
- You understand your access may be modified or revoked by project administrators
7.3 Shared Data
When collaborating on projects, be aware that:
- Other team members may view data you contribute based on their permissions
- Project owners can export or delete project data
- Deleting your account may not remove contributions to shared projects
8. Intellectual Property
8.1 Our Intellectual Property
The Service and its original content (excluding User Content), features, and functionality are owned by Anna Bradshaw Consulting Services and are protected by copyright, trademark, and other intellectual property laws.
You may not:
- Copy, modify, or distribute the Service or its content
- Use our trademarks without prior written consent
- Create derivative works based on the Service
- Remove any copyright or proprietary notices
8.2 Feedback
If you provide feedback, suggestions, or ideas about the Service, you grant us a non-exclusive, royalty-free, perpetual license to use, modify, and implement such feedback without compensation or attribution.
9. Payment Terms
9.1 Free and Paid Services
The Service may offer both free and paid features. Specific pricing and payment terms will be clearly communicated before any charges are incurred.
9.2 Billing
For paid services:
- You agree to pay all applicable fees
- Fees are non-refundable except as required by law
- We may change pricing with reasonable advance notice
- You are responsible for all applicable taxes

- Any damage or loss caused by third-party services

11. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.
To the fullest extent permitted by law, we disclaim all warranties, including but not limited to:
- Warranties of merchantability and fitness for a particular purpose
- Warranties that the Service will be uninterrupted, error-free, or secure
- Warranties regarding the accuracy or reliability of information
- Warranties that defects will be corrected
You use the Service at your own risk. We do not warrant that:
- The Service will meet your specific requirements
- Results obtained from the Service will be accurate or reliable
- Any errors in the Service will be corrected
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL ANNA BRADSHAW CONSULTING SERVICES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.
This includes, but is not limited to, damages for:
- Loss of profits, revenue, or data
- Business interruption
- Loss of goodwill or reputation
- Cost of substitute services
- Any other intangible losses
Our total liability for any claims arising from or related to the Service shall not exceed the greater of:
- The amount you paid us in the 12 months preceding the claim, or
- 100 EUR
Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability, so some of the above limitations may not apply to you.
13. Indemnification
You agree to indemnify, defend, and hold harmless Anna Bradshaw Consulting Services and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from:
- Your use of the Service
- Your User Content
- Your violation of these Terms
- Your violation of any third-party rights
- Your violation of any applicable laws
14. Termination
14.1 Termination by You
You may terminate your account at any time by:
- Using the account deletion feature in the app settings
- Contacting us at support@gethomenest.com
14.2 Termination by Us
We may suspend or terminate your account immediately, without prior notice, if:
- You violate these Terms
- You engage in fraudulent or illegal activities
- Your use poses a security risk
- Required by law
- The Service is discontinued
14.3 Effect of Termination
Upon termination:
- Your right to access the Service immediately ceases
- We may delete your User Content according to our data retention policy
- Provisions that should survive termination (such as limitations of liability) will remain in effect
14.4 Data Export
Before terminating your account, you may request a copy of your data by contacting us. We will provide your data in a commonly used format within 30 days.
15. Changes to Terms
We reserve the right to modify these Terms at any time. When we make changes:
- We will update the "Last updated" date
- For material changes, we will provide notice through the Service or via email
- Continued use of the Service after changes constitutes acceptance
If you do not agree to the revised Terms, you must stop using the Service and may terminate your account.
16. Governing Law and Dispute Resolution
16.1 Governing Law
These Terms shall be governed by and construed in accordance with the laws of Poland, without regard to conflict of law principles.
16.2 Jurisdiction
Any disputes arising from or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Poland.
16.3 EU Consumer Rights
If you are a consumer in the European Union, you may also have rights under the laws of your country of residence. Nothing in these Terms affects your statutory rights as a consumer under applicable EU law.
16.4 Alternative Dispute Resolution
If you are an EU consumer, you may also seek resolution through the Online Dispute Resolution platform: https://ec.europa.eu/consumers/odr
17. General Provisions
17.1 Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the Service.
17.2 Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
17.3 Waiver
Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
17.4 Assignment
You may not assign or transfer your rights under these Terms without our prior written consent. We may assign our rights without restriction.
17.5 Force Majeure
We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including natural disasters, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, strikes, or shortages of transportation, facilities, fuel, energy, labor, or materials.
17.6 Language
These Terms are provided in English. In case of any discrepancy between translations, the English version shall prevail.
